1. Who we are

This store is operated by Jorge Sousa, taxpayer number 210482575, Porto, Portugal. You can reach us at support@oralvyn.com. Throughout these terms, "we", "us" and "Oralvyn" mean Jorge Sousa, and "you" means the customer.

2. These terms

By placing an order you accept these terms. Please read them before ordering. We may update them; the version in force is the one published on this page on the date of your order, and changes never apply retroactively to orders already placed.

3. Who can order

You must be at least 18 years old to buy from this store. Our whitening products are not intended for use by anyone under 18, or during pregnancy or breastfeeding. If you have gum disease, exposed dentine, untreated cavities, crowns, veneers or fillings on visible teeth, or any other dental condition, speak to a dentist before using a whitening product. Whitening products act on natural tooth enamel and will not change the colour of crowns, veneers or fillings. See our Disclaimer for full details.

4. Products and descriptions

We take care to describe our products accurately. Product images are illustrative and colours may vary slightly with your screen. Results from cosmetic products vary from person to person and depend on consistent use; nothing on this store is a promise of a specific result for you.

5. Prices and payment

Prices are in euros and include VAT at the applicable rate. Delivery costs are shown separately at checkout before you pay. We may change prices at any time, but a change never affects an order already placed.

Payment is taken at checkout through our payment provider. We do not store your card details.

6. Orders and contract formation

Your order is an offer to buy. The contract is formed when we send you an order confirmation email. If we cannot accept your order — because an item is out of stock, because a price or description was clearly wrong, or because we cannot deliver to your address — we will tell you and refund any payment in full. We reserve the right to limit quantities per customer.

7. Delivery

Delivery terms are set out in our Shipping Policy, which forms part of these terms. Risk in the goods passes to you on delivery.

8. Returns, withdrawal and guarantees

Your right of withdrawal, our 30-day money-back guarantee and the legal guarantee of conformity are set out in our Refund Policy, which forms part of these terms. Nothing in these terms limits your statutory rights as a consumer.

9. Accounts

If you create an account, keep your password confidential and tell us promptly if you believe someone else has used it. You are responsible for activity under your account.

10. Acceptable use

Do not use this store for any unlawful purpose, do not attempt to interfere with its operation or security, and do not scrape, copy or resell its content without our written permission.

11. Intellectual property

The Oralvyn name, logo, site content, images and text are owned by us or used under licence, and may not be reproduced without our written permission.

12. Liability

We are liable to you for foreseeable loss caused by our breach of these terms. We do not exclude or limit our liability where it would be unlawful to do so — including liability for death or personal injury caused by our negligence, for fraud, or for your statutory rights as a consumer. Always follow the instructions supplied with a product.

13. Privacy

We process your personal data as described in our Privacy Policy.

14. Complaints and dispute resolution

If something has gone wrong, email us first at support@oralvyn.com — most issues are resolved within one business day.

As a consumer in Portugal, you may also submit a complaint through the electronic complaints book at www.livroreclamacoes.pt.

For out-of-court dispute resolution, you may refer a dispute to CICAP — Centro de Informação de Consumo e Arbitragem do Porto, Rua Damião de Góis 31, loja 6, 4050-225 Porto, www.cicap.pt. Consumers resident in other EU Member States may contact the European Consumer Centre in their country.

15. Governing law

These terms are governed by Portuguese law. If you are a consumer resident in another EU Member State, you also keep the protection of any mandatory provisions of the law of your country of residence, and you may bring proceedings in the courts of that country.
